These Terms & Conditions (“Terms”) govern all donations made through the website globalasm.com (“Website”) operated by ASOCIACION CENTRO OPERATIVO GLOBAL ASM (“we,” “our,” or “us”). By making a donation, you (“Donor,” “you,” or “your”) agree to these Terms and our Privacy Policy. If you do not agree, please do not proceed with a donation.

1. Nature and Purpose of Donations

1. Donations are voluntary contributions intended to support our mission of provide social entities with an operational center for the management of different social and humanitarian work activities both nationally and internationally. We are committed to providing grants, microcredits and logistical support to indigenous small businesses in developing countries to stimulate their economic growth.
2. Unless otherwise stated for a specific fundraising campaign, donations will be allocated at our sole discretion toward areas of greatest need in line with our mission.
3. Donations do not constitute a purchase of goods or services and do not entitle donors to any ownership, voting rights, or participation in the governance of our organization.

2. Eligibility to Donate

1. You must be at least 18 years old or have the permission of a legal guardian to make a donation.
2. By donating, you confirm that the funds are your own and that you are not violating any applicable laws or regulations.

3. Payment Processing

1. Donations are processed through secure third-party payment processors (GetNet). We do not store your full payment information.
2. By making a donation, you also agree to the terms and privacy policies of the payment processor.
3. You are responsible for ensuring your payment details are accurate and authorized.

4. Currency & Fees

1. Donations may be processed in Euros, and conversions to your local currency may result in different amounts appearing on your bank statement.
2. Some banks and payment providers may charge foreign transaction or processing fees, which are your responsibility.

5. Refund Policy

1. All donations are final and non-refundable, except in cases of:

1. • Proven technical error (e.g., duplicate payment)

   • Unauthorized transaction (fraud)

2. Refund requests must be made in writing within 14 days of the donation date, including proof of the transaction.
3. Approved refunds will be processed back to the original payment method where possible.

6. Tax Deductibility

1. ASOCIACION CENTRO OPERATIVO GLOBAL ASM is a registered nonprofit (G16478851) in Spain.
2. Donations may be tax-deductible in your jurisdiction; consult your tax advisor.
3. Receipts for eligible donations will be provided upon request or automatically if required by law.

7. Donor Privacy

1. We collect and process personal data (such as your name, contact information, and donation details) to process donations, issue receipts, and comply with legal requirements.
2. We will not sell, rent, or trade donor information.

8. Prohibited Donations

You may not donate funds that:

1. Originate from illegal activities, including money laundering or terrorist financing.
2. Involve stolen payment instruments or unauthorized account access.
3. Violate applicable laws or sanctions.

We reserve the right to report suspicious transactions to relevant authorities.

9. Recurring Donations

1. If you set up a recurring donation, your payment method will be charged automatically at the frequency you select.
2. You may modify or cancel recurring donations by contacting us at least 14 days before the next scheduled payment.

10. Limitation of Liability

To the fullest extent permitted by law:

1. We are not liable for any indirect, incidental, or consequential damages arising from your donation or use of the Website.
2. Our total liability for any claim related to your donation will not exceed the total amount you donated in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms at any time without prior notice. The updated version will be posted on this page, and the “Last Updated” date will reflect the change. Continued donations after updates constitute acceptance of the revised Terms.

12. Governing Law & Dispute Resolution

1. These Terms are governed by the laws of Spain, without regard to conflict of law principles.
2. Any disputes will be resolved exclusively in the courts of Madrid, unless otherwise required by applicable law.
